What is the difference between assault and battery?
Q. From what I can find on the Internet, it looks like assault and battery are pretty much the same thing. In the United States, is there a significant difference between assault and battery?
Asked by Joe - Wed Sep 3 17:48:06 2008 - - 6 Answers - 1 Comments
A. Assault is a threat of physical harm. Battery is actual physical harm and there is always assault if there is battery. Example: someone raises a fist and says "I'm gonna knock your teeth out." That would be assault, but not battery since they never actually hit you. But if someone walks up and punches you in the face, its battery. It is considered assault the moment they make a fist and raise it, so by definition, there is always assault when there is battery. Assault with a deadly weapon is a more extreme charge. It would be a case where there was a threat involving anything that could be potentially deadly. For example if someone threatened you with a knife or a gun, it would be assault with a deadly weapon. If someone commits… [cont.]

What is a man who has pleaded guilty to indecent assault on a minor likely to get?
Q. My step daughter was indecently assaulted by her Grandfather (My husbands ex-wifes Father) she was 13 at the time of the assault (and not in our care) but is now age 16. This disgusting excuse of a human has also abused 4 other members of the family. The CPS court case was put together charging him with all the cases but the other 3 cases were weak as the children involved were young and two had learning difficulties. On his solicitors advice this man denied all the other charges except the indecent assault charge on my step daughter, and pleaded guilty to this. As a result all the other charges have been dropped (due to lack of evidence) and he is to be sentenced only for my step daughters assault. He has good references from his work (p [cont.]

The chances are that though the other instances have been dropped this will come up when he is sentenced which is why the CPS has dropped the weaker cases. Is it ethical to file assault charges against a 13 year old with no prior history of violence?
Q. My son was in a fight at school and the other boy busted his front tooth. It will cost several thousand dollars to repair. I've been told that if the other parents don't agree to help with the costs that I should press assault charges against the boy. I don't agree because this could potentially destroy this child's life. Would you file charges?
Asked by BeenThere - Wed Dec 19 20:58:16 2007 - - 13 Answers - 0 Comments
A. The decision to press criminal assault charges should made without considering whether you get any money or not. Threatening to bring criminal charges just to leverage the parents into paying would be unethical.

Can assault charges be dropped by person who originally filled the charges in saskatchewan ?
Q. Got charged with assault, person was drunk and high when they wrote the statement and now wants to drop the charges. Can they do that ?

A. Anyone in Saskatchewan (or anywhere else in Canada I would assume) who has filed any charges can drop them for any reason. This can be a person, or the Crown if they feel it necessary. In this case, the person who was drunk and high has every right to drop charges against you, but it sounds like you may want to inquire about having them charged with making a false statement to police. By the way, why is this posted in Earth Sciences and Geology??

What is the difference between the types of Assault? What makes one a misdemeanor vs felony?
Q. If there was no conventional weapon, but a blunt object was used. The victim was also struck in the head from behind. Doctors confirmed injury was from a blunt object, not a fist. The offender was intoxicated and probably did not "intend" to do great bodily harm. If anyone had to guess - what type of assault would this be classified as? Also, when police arrived - the offender was not charged or arrested. Are they waiting to have all the evidence from the hospital, witness statements and talk to the D.A. first? In the State of Michigan, by the way

A. Intent does not matter, if he used a blunt object (defined below as a "club"), it will be a felony. 750.82 Felonious assault Sec. 82. (1) Except as provided in subsection (2), a person who assaults another person with a gun, revolver, pistol, knife, iron bar, club, brass knuckles, or other dangerous weapon without intending to commit murder or to inflict great bodily harm less than murder is guilty of a felony punishable by imprisonment for not more than 4 years or a fine of not more than $2,000.00, or both. As far as why he was not charged on the spot, that would be speculation.

A. It may show up as dismissed or diverted (depending on the disposition of the case). Go to or call your District Court clerk (probably located in the court house) and ask about expunging your record. There may be a small fee, but it would not show up on your record.

What is the most likely outcome for someone charged with assault and disorderly conduct?
Q. Basically, what does the military do with people charged with assault and disorderly conduct, as it happened on a military base? Does it depend what the person actually did? The person is a soldier.

A. If you're a soldier, Article 15 or worse. You get fined, you could get demoted. Every scenario is different. That person should be assigned a lawyer already. If you're a civilian, you're still governed by UCMJ - military law, because of where the incident took place. You can hire a private lawyer, however.

If he or she decides prosecution is merited, then charges will be filed against your assailant. You will both appear in court where you may be called upon to testify as to what happened and the prosecutor will present the evidence (your pictures, testimony from other witnesses, etc.). Are there statistics as to what percentage of men will sexually assault a woman?
Q. We've all heard plenty of statistics about the number of women that will be sexually assaulted in their lifetime. It's difficult to estimate, I know, but apparently one out of every ten women will be raped and one out of every four women will be sexually assaulted in some manner. There is less data, or scientific estimation, as to how many men will commit a sexual crime (first, second, or third degree) in their lifetime. Does anyone know the statistics on that? What percentage of men will be rapists? What percentage will commit sexual assault?

A. i don't know about that. interesting question. i wonder how many of the ones that do it a "first time" fallback into that pattern the first time they get a chance? sometimes the prison system fails to rehabilitate these things. let's punish punish punish, and then release... rather than fixing the actual problem that caused the criminal to commit the terrible crime in the first place. i wonder if that percentage is going down, since so many men are locked inside of their mom's basement now, not paying any rent, not changing their clothes, and playing halo-3 and world of warcraft for their entire young adult lives?
